American Officers to Testify in Gotovina’s Defence

This is the first time the Pentagon gave a green light to their officers to testify for the defence in The Hague, Hrvatski list reports.

Lajla Mlinarić V.T. ZAGREB, CROATIA – Richard Herrick, John Sadler and Ivan Sarac will testify for the defence of Croatian generals in front of the international war crimes tribunal in The Hague, Hrvatski list reported, adding that this is the first time that the U.S. Department of Defence gave a green light to its people to testify for the defence in The Hague.

Pursuant to a request by Croatian General Ante Gotovina’s defence, the U.S. Department of Defence gave approved testimony of its officers who were American military and diplomatic representatives in Croatia during the 1990’s Croatian Homeland War.

Twist in the proceedings against Croatian generals

The testimonies of Richard Herrick and John Sadler, who were American military envoys to Croatia in the 1900’s and Ivan Sarac, who was deputy military envoy at the U.S. Embassy in Zagreb, could mean a twist in the proceedings against Croatian generals Gotovina, Markac and Cermak, the paper writes.

The Hague’s prosecution so far ignored all facts and witnesses whose testimonies brought into question the main theses of the indictment, such as the report of a Norwegian officer, who was a UN chief observer in Knin, in which he denied excessive shelling of Knin. The prosecution refused to even include him in the list of witnesses.

The prosecution ignored acquitting evidence

Hrvatski list writes that the prosecution had insight into and had evidence of acquitting evidence, but chose to ignore it and so misled the Chamber of Judges.

Such is the case with Ivan Sarac who, according to Hrvatski list, have a deposition to the tribunal’s investigators in Paris in 2004, but the prosecution never included him on the witness list.

I want to see this, I'm a strong believer in his being a scapegoat.

In a time of war, he did what needed to be done, his people were being murdered and no outsiders were willing to help. Who knows how many thousands of other lives would have been lost had he too chosen to do nothing?

I plan to do more research, but based on what I've found so far, I tend to see him as more of a hero than a villian also.

Ma gotovo nitko nije ni pomislio da će biti osuđen. Nakon što je Gotovini izrečena presuda od 24 godine, začuli su se jecaji, a i pokoja psovka na adresu Haaškog suda.

– Ovo je presuda hrvatskom narodu, a ne Anti Gotovini. Užas! Ipak, postoji pravo na žalbu, pa ćemo vidjeti – rekao je Ante Žoni Maksan, generalov suborac i prijatelj.

Očekivali ga na misi
Ivica Kapitanović, branitelj kojemu je Gotovina bio zapovjednik, kroz suze je govorio kako je posljednji put plakao kada je pokapao suborce u ratu.

– Što sada da kažem svojoj djeci, što se događalo u ratu i tko je koga napadao? Što da radim sa svojim vojnim odorama onako složenima? Očekivali smo Gotovinu kod kuće, a ovako su ga osudili. Pa kako je to moguće? Pogledajte kakav je Haag bio prema Šljivančaninu, koji je na Vukovar ispalio 5000 granata. Ovo su zasluge svih vlasti, i one od 2000., i Sanaderove koja je pokrala Hrvatsku, a i među ovima ima zaslužnih – rekao je.

Mnogi su, naime, tvrdili kako je očito riječ o političkoj presudi i kako je Gotovina žrtvovan radi odnosa u regiji, odnosno kako je osuđen iako je poznato da je zapovijedao vojskom koja se branila od srpske agresije. Marija Miočev, Gotovinina teta, plačući je vikala na rivi kako je njezin Ante prodan, i to od politike koja je, kako je rekla, htjela spasiti svoju fotelju Generalov prijatelj i općinski načelnik Milivoj Kurtov rekao je kako je očito da su svi koji su vjerovali da će biti oslobođen bili naivni.

– Tužan sam i razočaran. Što sad napraviti? Sad smo nemoćni – bio je utučen. Nekoliko sati nakon presude, i brojni su drugi Pakoštanci izišli na rivu.

– Ante nije bio zločinac. Ako je on zločinac, onda smo i svi mi zločinci – rekao nam je jedan od pakoštanskih branitelja, a iz lokalnih kafića baš u to vrijeme netko je pustio pjesmu “Sude mi”...

U Zadru je na mostu osvanuo 50 metara dug transparent “Generale, čekamo zapovijed”. Nakon izricanja presude, jedan je 53-godišnjak šakom razbio izlog panoa na Narodnom trgu te je po njega došla hitna pomoć.

Jack Baric: I'm shocked beyond words. The EU and the UN just stood and watched as Vukovar, Srebrenica and Sarajevo happened and then harshly criticized Croatia when it finally had the means to fight back and defend. Today's verdict against General Gotovina is just their way of defending their inept and cynical policies. Shame!

- Mogu samo reći da nam je nevjerojatno što se dogodilo u ovome predmetu, kao da sudac Orie nije ništa čuo od obrane. Očekujem da će žalbeno vijeće poništiti ovu odluku, optimistično je rekao odvjetnik Mišetić.

12.15 sati Markačev odvjetnik Goran Mikuličić je izrazio nezadovoljstvom presudom te najavio žalbu.

12.10 sati Nakon presude diljem Hrvatske zavladali šok i nevjerica. Tisuće ljudi okupljenih na središnjem zagrebačkom Trgu ogorčeni su presudama generalima. Hrvatski politički vrh šokiran je haaškim presudama.

Ako je Markač dobio informacije njegova je dužnost bila da obavijesti policiju te da se dotični pripadnici specijalne policje suspendiraju, smatra Vijeće.

11.52 sati Vijeće je za generala Ivana Čermaka zaključilo da tužiteljstvo nije dokazalo optužnicu protiv njega te da nije bio član udruženog zločinačkog pothvata niti da mu je doprinio, te da nije za to odgovoran. Čermak je oslobođen po svim točkama optužnice i odmah ide na slobodu. Vijeće je ustanovilo da je Čermak davao obmanjujuća uvjeravanja međunarodnoj zajednici da će se zaustaviti zločini nad Srbima.

11.47 sati Ante Gotovina je osuđen na jedinstvenu kaznu na 24 godine zatvora! Proglašen je krivim kao sudionik udruženog zločinačkog pothvata i to po devet točaka optužnice. Gotovina nije proglašen krivim samo za točku 3 koja podrazumijeva nečovječna djela i prisilno premještanje. Zbog propusta u smislu ne spriječavanja zločina Vijeće je zaključilo da je Gotovina značajno doprinio udruženom zločinačkom pothvatu.

11.37 sati Vijeće je zaključilo da je Ante Gotovina bio general pukovnik i zapovjednik sektora Split i upravo zbog svoje pozicije zapovijedao je svim jedinicama na tom području. Granatiranje Benkovca i Obrovca naredio je Gotovina i predstavlja nezakonit napad na civile, zaključilo je Vijeće. Gotovina je prisustvovao na Brijunskom sastanku i aktivno je sudjelovao u planiranju Oluje, dodaje sudac Orie.

11.35 sati Nalozi generala Gotovine za nezakonite napade na ciljeve i civile dovele do značajnog doprinosa udruženom zločinačkom pothvatu. Temeljem njegovog ponašanja, sudsko vijeće zaključuje da je Gotovina smatrao da kaznena djela mogu biti počinjena te zaključuje da je Gotovina bio član udruženog zločinačkog pothvata.

11.34 sati Vijeće je utvrdilo kako se dio hrvatskog političkog i vojnog vrha, predvođen tadašnjim predsjednikom Franjom Tuđmanom, ministrom obrane Gojkom Šuškom i načelnikom Glavnog stožera Zvonimirom Červenkom, udružio u zločinački pothvat, a kao ključnu točku tog pothvata navodi sastanak na Brijunima 31. srpnja, uoči pokretanja akcije Oluja, rekao je sudac Orie. Sud smatra da je Tuđman bio ključna figura udruženog zločinačkog pothvata i da je namjeravao tzv. Krajinu naseliti Hrvatima.

11.33 sati Vijeće je zaključilo da je HV topništvo namjerno granatiralo i ciljeve koji nisu prethodno utvrđeni kao vojni ciljevi. Vijeće je zaključilo da granatiranje Benkovca, Gračaca, Knina i Obrovca predstavljja nediskriminatorni napad na grad i na civile i civilne objekte...

11.30 sati Pripadnici Hrvatske vojske i specijalne policije učinile su kazneno djelo ubojstva, razaranja, pljačke, progona i deportacije, kao što je navedeno u optužnici, kaže sudac Orie.

11.25 sati Vijeće je zaključilo da je 4. i 5. kolovoza '95 velik broj ljudi napustilo Benkovac, Knin, Gračac i Obrovac koji su se uputili prema BiH i Srbiji. Sudsko vijeće smatra da prisilno iseljavanje koje je činila Hrvatska predstavlja deportaciju stanovništva.

11.15 sati Orie čita za što se terete generali. U svom iskazu osvrnuo se i na traganje za "topničkim dnevnicima". Vojno-redarstvenu operaciju Oluja proglasio je “udruženim zločinačkim pothvatom kojemu je cilj bio trajno iseljenje srpskog naroda sa područja Hrvatske”.

11.05 sati Sudac Alphonse Orie počeo čitanje skraćene verzije zaključaka Vijeća suda.

11.03 sati U haaškoj sudnici nalaze se generali Gotovina, Markač i Čermak, tročlano vijeće predvođeno sucem Orijem, tužitelji i predstavnici obrane te promatrači.

11.00 sati U sudnici broj 1 Haaškog suda počelo čitanje presude generalima Anti Gotovini, Ivanu Čermaku i Mladenu Markaču.

9.50 sati Jutros nije bilo velike gužve ispred Haškog suda, novinari, ali i posjetitelji koji žele sa sudske galerije svjedočiti odlučivanju o daljnjoj sudbini trojice hrvatskih generala, počeli su dolaziti i nekoliko sati prije najavljenog izricanja presude.

9.30 sati U Zagrebu se na Trgu bana Josipa Jelačića na skupu potpore hrvatskim generalima oko 9.30 sati okupilo nekoliko stotina ljudi.

9.15 sati Rano jutros u mjesnoj crkvi u Gotovininim Pakoštanima služena je misa za njega.

8.20 sati Na zadarskom gradskom mostu jutros je osvanuo ogromni transparent s natpisom "GENERALE, ČEKAMO ZAPOVIJED".

I can't believe this result - it's not justice, it's wrong. I have a clip of Gotovina berating his officers in a meeting for some minutes over the treatment of civilians and enemy soldiers, and his message over and over was about how wrong it was to make themselves smaller by being cruel, etc.

I'm angry and saddened by the verdict.

I need to find the clip on one of my external hard drives, but here is a version of it from YouTube I found. There is no translation here, but Gotovina is berating his generals for allowing the men under them to loot and burn citizens homes, etc. He is understandably furious, stating that as leaders, they are responsible for the conduct of their men, and it is wrong to act with less than honor, and to basically get their asses in gear and stop the brutality. that to do nothing is to condone it.

Split City Council on Thursday unanimously decided to grant general Ante Gotovina, one of the central squares of Split. The condition is that it previously approved by the Commission for the naming of streets, squares and monuments, and personally I Gotovina.

Postupak proglašenja generala Ante Gotovine počasnim građaninom Splita je u proceduri od 2001. godine, te se po tom pitanju očekuje očitovanje komisije za dodjelu javnih priznanja, istaknula je Nevenka Bečić, predsjednica splitskog Gradskog vijeća nakon što je to isto predložio na sjednici u četvrtak splitski HSP.

Luka Roguljić, vijećnik te stranke zatražio je da se taj postupka ubrza, te da se u dnevni red uvede imenovanje nekog od središnjih gradskih trgova imenom zatvorenog hrvatskog generala. Hrvoje Tomasović, čelnik HSP-a izgubio je strpljenje i napustio je sjednicu Gradskog vijeća prilikom uvođenja prijedloga njegovog stranačkog kolege. Na kraju je prijedlog HSP-a uvršten kao posljednja, 46. točka, Dnevnog reda sjednice Gradskog vijeća.

- Sramite se svi skupa! Ovakvi kao vi strpali su ga na 24 godine – teatralno je zagrmio Tomasović napuštajući vijećnicu.

Svojim istupom HSP-ovac je iznenadio vijećnike, a Marin Jurjević iz SDP-a je zaključio kako je to bilo ružno ponašanje.

- Neću da me se vrijeđa. Ovo je bilo jeftino skupljanje političkih poena. Želim ispriku - rekao je Jurjević s kojim se složila i Kerumova sestra Nevenka.

Nakon toga su zastupnici uz jedan pravaški glas protiv izglasali da se Tomasović mora ispričati, piše Slobodna Dalmacija. Predsjednica Bečić podsjetila je na činjenicu da je 2001. godine predloženo Vijeću da se Gotovinu proglasi počasnim Splićaninom te će Komisija za imenovanje ulica i trgova o tome odlučivati na temelju tog prijedloga iz 2001. godine.

Goran Hadzic, President of the Government of the self-proclaimed Serbian Autonomous District Slavonia, Baranja and Western Srem (SAO SBWS) and subsequently President of the Republic of Serbian Krajina (RSK) in Croatia 1991-1993 was arrested (July 20011) in Serbia after seven years on the run and in hiding.

Indicted for war crimes against Croatian people: persecutions on political, racial or religious grounds; extermination; murder; imprisonment; torture; inhumane acts; deportation and forcible transfer; cruel treatment; wanton destruction of villages, or devastation not justified by military necessity; destruction or wilful damage done to institutions dedicated to education and religion; and plunder of public or private property.

The indictment alleges that Hadžić participated in a joint criminal enterprise (JCE) (headed by the president of Serbia at the time, Slobodan Milosevic) as a co-perpetrator.

The purpose of the joint criminal enterprise was the permanent forcible removal of a majority of the Croat and other non-Serb population from a large part of the Republic of Croatia in order to make it part of a new Serb-dominated state. The areas in question included those regions that were referred to by Serb authorities as the “SAO Krajina,” the “SAO Western Slavonia,” and the SAO SBWS. By 26 February 1992, all of these areas had become part of the self-proclaimed RSK.

It is alleged by ICTY that the joint criminal enterprise came into existence no later than 1 April 1991, and continued until at least 31 December 1995.

His trial will start October 16, 2012, the International Criminal Tribunal for the former Yugoslavia as announced Friday, 16 December 2011. Pre-Trial Judge Guy Delvoie made the decision after advising the prosecution and defence of the date. http://www.icty.org/x/cases/hadzic/tdec/en/111216.pdf

The indictment above unequivocally points to the absolute need of Croatians to defend and liberate their lives and territory. Hence, Operation Storm in August 1995.

This is where Generals Ante Gotovina and Mladen Markac come in – to any peace-loving and freedom-minded person they are heroes to the multitude of people whose lives they saved, whose homes they’ve restored.

Although convicted for war crimes by the ICTY in April 2011, their convictions are on Appeal.

And in light of this the Croatian World Congress (HSK) has printed 100,000 Christmas cards they plan to send to Croatian generals detained at the International Criminal Tribunal for the former Yugoslavia (ICTY) in the Hague.

The cards will be distributed to Croatians living in Germany, Switzerland, Austria, France, Sweden and Netherlands who want to send Christmas greetings to general Ante Gotovina and other Hague inmates.

The Christmas cards have a pre-printed statement but also room for a personal message, HSK Secretary Danijel Lucic says.

Of course the Appeal at the ICTY is still revolving around General Gotovina’s motions to introduce new evidence (from Serbia) which could demonstrate that the masses of Serbs who fled Croatia at the finish of Operation Storm in August 1995, left of their own volition or at request of their leaders, and were not expelled as the ICTY conviction ruled. Certainly it seems that the ICTY tries hard to avoid sending a subpoena or something like it to Serbia for the documents by way of a court order. http://inavukic.com/2011/11/20/general- ... the-hague/

In its latest filing to the Appeals Chamber of the Hague war crimes tribunal, defence counsel for Croatian General Ante Gotovina says that the Appeals Chamber should admit 25 additional documents because they constitute new evidence that would have changed the trial court ruling had they been available to the court, thus dismissing the prosecution’s arguments opposing the admission of new evidence, the Hague tribunal said on Monday.

The defence team representing Gotovina before (ICTY) on November 4 filed, again, a motion to introduce new evidence in the appeal, including the minutes of meetings of the Serbian Supreme Defence Council held in Belgrade during a Croatian military offensive known as Operation Storm in the summer of 1995, U.S. diplomatic dispatches released by the whistle-blower website WikiLeaks, and expert reports by US officers.

“All of the Category I documents could have impacted the verdict because they establish not only that the evacuation order (from the rebel Serb leadership) was the primary and direct cause of departure, but also because they establish that the Croatian Army (HV) artillery attack was not,” the defence says in its filing.

The trial chamber established the expulsion of the Serb population committed through random artillery attacks that sent civilians fleeing, thus dismissing the defence’s evidence that the rebel Serb authorities had called for the evacuation of civilians and that the artillery attacks were directed against military targets. http://daily.tportal.hr/166064/Gotovina ... dence.html

Let’s watch and see whether the ICTY will allow the new evidence into court which could render the original conviction unsafe, overturn it etc., as far as the joint criminal enterprise for alleged expulsion of Serbs is concerned, anyway.

ICTY was established in accordance with Chapter VII of UN Charter.

Article 51 of that Charter reads: “Nothing in the present Charter shall impair the inherent right of individual or collective self-defence if an armed attack occurs against a Member of the United Nations, until the Security Council has taken measures necessary to maintain international peace and security. Measures taken by Members in the exercise of this right of self-defence shall be immediately reported to the Security Council and shall not in any way affect the authority and responsibility of the Security Council under the present Charter to take at any time such action as it deems necessary in order to maintain or restore international peace and security”. http://www.un.org/en/documents/charter/chapter7.shtml

The UN forces were present in Croatia when Operation Storm occurred.

So I ask myself: why is it so difficult for the ICTY to allow new evidence into the Gotovina appeal? Why is it so hard to get the documents from Serbia and the UN? This is simply unjust.
